These Terms of Service ("Terms") govern your access to and use of Dash Pods (the "Game"), developed and published by Agniveer Corporation ("we", "us", or "our"). By installing, accessing, or playing the Game, you agree to be bound by these Terms. If you do not agree, do not install or use the Game.
You must be at least 13 years of age (or 16 in the European Economic Area) to use the Game. If you are between 13 and the age of majority in your jurisdiction, you must have your parent or legal guardian review and accept these Terms on your behalf. By accepting these Terms, you represent that you meet these requirements.
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Game on a device that you own or control, solely for your personal, non-commercial entertainment purposes. All rights not expressly granted to you are reserved by Agniveer Corporation.
You may play as a guest (anonymous) or sign in with a Google account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must notify us immediately at agniveer171103@gmail.com if you suspect unauthorized use of your account. We are not liable for any loss or damage arising from your failure to safeguard your account.
We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if your conduct harms other players or the integrity of the Game.
The Game offers consumable in-app purchases (coins, gems, revives) via Google Play Billing (Unity IAP). All purchases are processed by Google and are subject to Google Play's payment terms. Prices are displayed in Indian Rupees (INR) and may include applicable taxes.
Coins, gems, and other virtual items obtained through gameplay or purchase have no real-world monetary value and are not redeemable for cash. You acquire a limited license to use virtual currency/items within the Game only.
All purchases are final and non-refundable, except as required by applicable law (e.g., EU consumer law provides a 14-day withdrawal period for digital content not yet consumed; by purchasing and consuming immediately, you expressly waive this right). The Game, including all code, artwork, music, sound effects, characters, hero designs, enemy designs, levels, UI, text, and trademarks ("Dash Pods" and the Agniveer Corporation logo), is owned by Agniveer Corporation or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works without our prior written permission.
The Game integrates with third-party services including Google Firebase, Google AdMob, Google Sign-In, Google Play Games Services, and Unity IAP. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.
The Game displays rewarded video ads via Google AdMob. Watching ads is entirely optional and you are not required to view any advertisement to play the Game. Ad content is served by Google and is not controlled by us.
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AGNIVEER CORPORATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE GAME, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Agniveer Corporation, its officers, employees, and affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Game, or your violation of any law or third-party rights.
We may terminate or suspend your access to the Game at any time, with or without cause or notice. Upon termination, your license to use the Game ends. Sections 5 through 14 of these Terms shall survive termination.
These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms or the Game shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Pune, Maharashtra, India. You agree that any cause of action you may have must be commenced within one (1) year after the claim arose.
We may update these Terms from time to time. Material changes will be notified via the Game (e.g., a prompt on launch). Your continued use of the Game after changes take effect constitutes your acceptance of the revised Terms.
